    What are my options if I believe I should have been given settled status but was granted pre-settled, or if I was refused (pre-) settled status?

    Administrative reviews

    It was previously possible to apply for an administrative review of your application if you thought there had been a mistake. However, if your decision was on or after 5 October 2023, it is no longer possible to apply for an administrative review.

    Note that we still receive reports of very long delays (in excess of twelve months) on  processing administrative reviews that were submitted before October 2023.

    Appeals

    Applying again

    In some circumstances it is also possible to apply again for pre- or settled status if the first application you made was refused, but since the EU Settlement Scheme deadline of 30 June 2021, legal advice is recommended before doing this.  In particular, please see this important FAQ on late applications, which explains how the Home Office changed its processes in August 2023 around late applications.
