    I am a family member of someone with (pre-) settled status, and I have come to the UK on a visitor visa. Can I apply to the EU Settlement Scheme?

    You cannot enter the UK as a visitor with an intention to apply to the EU Settlement Scheme.

    In September 2021 there were however changes to the Immigration Rules in Appendix EU to allow those who are in the UK as a visitor to apply to the EU Settlement Scheme. See our webpage Travel to the UK and the 'Guidance for Advisors' for more details. Please note, as explained in table 3 of that guidance, that applying to the EUSS as a visitor could have good character implications in the future e.g. when naturalising.

    We recommend you seek legal advice if wanting to apply to the EU Settlement Scheme from within the UK if you are here on a visitor visa.

    Alternatively, you can leave the UK and apply to the EU Settlement Scheme from abroad - either for an EU Settlement Scheme family permit or an EU Settlement Scheme status.
