Watch the hearing in the Court of Appeal


Tomorrow, Wednesday 14 May 2025 is the long-awaited start date of the Court of Appeal hearing of the Fertre case - we are intervening in the appeal as part of our fight for equal treatment for all EU citizens and family members.

This case is about ensuring people with pre-settled status have the same access to welfare as British citizens - without unfair extra barriers that the Government has put in place just for pre-settled status holders.

Why this case is so important

We are fighting for fairness. Currently, people with pre-settled status are denied equal access to welfare benefits, and we believe this is both unjust and unlawful. EU citizens, like British nationals, should have the same rights and protections, due to the Withdrawal Agreement.

The case is far from over. No matter the result of the hearing in the Court of Appeal, we anticipate that the losing side will want to appeal the judgment. This means the case could go to the Supreme Court, or it could be heard by the European Court of Justice.
